In our opinion November 12, 2002 Some of the rules and regulations that govern elections in this state are the result of a decades-old federal court order. Many others are legislative in their origins and could be altered if our representatives would do their job. But the foundation on which these laws rest is our antiquated constitution. Like most provisions in the 1901 document, those on elections and suffrage have been amended many times. These amendments add to the contradiction and confusion that we are feeling today. And like so many other reforms this state needs, election reform will be made easier when a new constitution is written and approved. Secretary of State Bennett, who is a leader for both constitutional and election reform, has repeatedly warned our executive and legislative departments that the lack of clear rules governing elections, including provisions for recounts, would lead us to trouble.
