Resolution of the
Alabama State Board of Education


RESOLUTION IN SUPPORT OF PROPOSAL
TO THE ALABAMA LEGISLATURE ON CONSTITUTIONAL CONVENTION


WHEREAS, the Alabama Constitution of 1901 was written with an intent to
centralize power and control of the state in the Alabama Legislature; and

WHEREAS, the Alabama Constitution of 1901 so restricts the flow of effective
and efficient government that it has been amended 706 times, with over 100
amendments dealing with local and state education issues; and

WHEREAS, the Alabama Constitution of 1901 preserves a failed system for
funding public schools and other governmental services which forces them to
suffer from inadequate and unpredictable funding; and

WHEREAS, Section 286 of the Alabama Constitution of 1901 permits the calling
of a constitutional convention:

NOW, THEREFORE, BE IT RESOLVED, That the Alabama State Board of Education
does hereby call upon the Alabama Legislature to enact proper legislation to
place before the voters of Alabama on November 5, 2002, a referendum to hold
a constitutional convention for the purpose of rewriting the Alabama
Constitution of 1901; and

BE IT FURTHER RESOLVED, That the Alabama State Board of Education does hereby
call upon the Alabama Legislature to enact proper legislation to place before
the voters of Alabama on November 5, 2002, an amendment to the Alabama
Constitution of 1901 authorizing local boards of education to petition their
local governing bodies for the authority to place before the local voters
certain decisions regarding their schools and ending the requirement to seek
such permission from the Alabama Legislature.
