WHEREAS,
Alabama adopted its existing Constitution in November, 1901, during
an era
vastly different from our own; and
WHEREAS the 1901
Constitution of Alabama reflects the values of the society that
ratified it,
rather than those of present-day Alabamians; and
WHEREAS
the 1901 Constitution of Alabama concentrates many elements of the
governing process
in the Alabama State Legislature rather than in County, City and
Town governments
that are closer to the constituents they serve; and
WHEREAS
the system of taxation inherent in the 1901 Constitution of Alabama
is unfair,
regressive, and unable to provide adequate resources for
Alabamians highest priorities such as education and public
safety; and
WHEREAS
the framers of the 1901 Constitution of Alabama anticipated that
it might
someday become obsolete, and so provided for a method for abolishing
and replacing it in
Section 286 thereof; and
WHEREAS it is
the judgment of the North Alabama Mayors Association that
is now necessary
and proper to call for a Constitutional Convention pursuant to Section
286 of the
1901 Constitution of Alabama in order to replace said Constitution;
NOW, THEREFORE BE IT RESOLVED BY
THE NORTH ALABAMA MAYORS ASSOCIATION AS FOLLOWS:
Section 1.
That the Association urges the Alabama Legislature to call for
a Constitutional Convention pursuant to Section 286 of the 1901
Constitution of Alabama,
and to put the question of such a Convention to the People of the
State of Alabama.
Section 2.
That the Association recommends that the Convention, if assembled,
replace the 1901 Constitution of Alabama with one that provides
for more governmental power
to serve the People at the local level, fairness in taxation, excellence
in education,
equal justice under law, securing of the public peace, tranquility
and safety, and a State Government
of which all the People can be proud.
